At the time of sale, the Dog is not known to have any health problems. Breeder cannot be responsible for conditions that occur after the Dog leaves Breeders control. This dog is sold as a pet and Breeder makes no warranties, expressed or implied, as to the fitness of this Dog for any other particular purpose. This Dog has received appropriate vaccines and care to date, as reflected in the records provided to Buyer and receipt of same is acknowledged by Buyer. The Breeder does not guarantee against internal/external parasites.
Within 72 hours of purchase, Buyer must have this Dog examined by a licensed veterinarian. If during this exam the Dog is found to have a serious health problem that existed prior to purchase, Buyer may return the Dog to Breeder immediately after said exam, with the Veterinarians written certification as to the health problem. In that case, Breeder will provide Buyer with another standard poodle of equal value as soon as one is available or provide a full refund within five days. If during said exam the Dog is found to be suffering from an illness or injury that commenced after purchase, the Dog may still be returned within 48 hours of the Exam and the refund will be reduced by the cost of veterinary treatment of the illness/injury.
While it is impossible to guarantee what genetic conditions may be latent in a dog, Breeder strives to breed dogs that are healthy and free of genetic problems. If this Dog should die before age 2 from proven genetic condition, Breeder will give Buyer a puppy from the next available litter at no charge, upon receipt of the AKC registration, heartworm preventative and vaccination history of the deceased dog and proof from a qualified veterinarian of the genetic cause of death.
This Dog is sold intact and is being sold without breeding rights. The Breeder recommends spaying or neutering this dog after 18 months of age or after first heat cycle in females, whichever is later. This puppy shall NOT be bred intentionally nor accidently to anything. If the puppy is bred there will be a $10,000 fine per breeding.
Buyer will limit the exposure of this Dog to other dogs and to high traffic areas (such as dog parks, public streets, pet stores, etc.) until the puppy is at least 16 weeks old and has been given its last or third vaccination, whichever occurs later.
This Dog will live as a member of Buyers family and shall be allowed to enjoy time with the family as well as proper time to exercise outdoors. The dog may be placed in an appropriate outdoor yard (fence with available water and shelter), when the hours and weather are appropriate, but shall not be neglected, left out or kenneled on a 24-hour basis.
Buyer will provide regular vet care, including, but not limited to: ensuring this Dog receives all its puppy shots if not given by Breeder (depends on age of this Dog when it leaves Breeders care), annual exams, inoculations and treatment as recommended by Buyer's vet for prevention or treatment of any condition, including flea/tick and heartworm prevention. This Dog will be properly licensed as per the rules of Buyers municipality.
Breeder strongly recommends that the Buyer completes at least one (1) obedience class with the Puppy and provide proper socialization opportunities for the Puppy.
This Dog can be returned to Breeder at any time; no reason is required. If Buyer is ever unable or unwilling to keep the Dog, Buyer shall immediately surrender it to Breeder. If Buyer ever believes the Dog should be euthanized due to temperament or health, then (except for a true emergency where time does not permit), Buyer will contact Breeder, and if Breeder prefers, Buyer will return the Dog rather than euthanize. No refund shall be made except as specifically set forth in this agreement or as otherwise expressly agreed to in writing by Breeder. Should Buyer breach or violate any portion of this agreement, Buyer agrees to immediately surrender the Dog to the Breeder and sign over the Dogs AKC and/or UKC to Breeder, Buyer shall be liable to Seller for liquidated damages in a sum of no less than twice the sales price of the Dog and in addition shall be liable for Breeder's attorney's fees and legal costs incurred in attempting to enforce this. Agreement.
This Agreement constitutes the entire agreement between the parties. This agreement is made under the Laws of Kentucky and any disputes arising out of this agreement or this sale shall be heard in the courts of Kentucky. Rights under this agreement are not transferable to any other person. Any changes or amendments must be made in writing signed by both Breeder and Buyer. A photocopy of this agreement shall be acceptable as the original.
The BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees, and does understand all the conditions of the Sales Agreement and Contract of Sale.
